SARS Debt Relief · Section 200 Compromise

SARS can legally write off what you can't pay.

Most people never find out, because no one shows them the law behind it. lawvero builds the case, files the request, and holds SARS to its own process. Fixed fee.

  • What it is

    A statutory write-off, not a favour

  • Who decides

A senior SARS official, on the facts

  • What we deliver

    A written, binding compromise agreement

01 · The law

This isn't mercy. It's a test SARS runs on itself.

Section 200 of the Tax Administration Act lets a senior SARS official write off part of a tax debt, but only if doing so secures a higher net recovery than chasing the full amount would. SARS isn't being generous. It's choosing the option that gets the taxman more money, faster, with less cost. If your case can show that a realistic settlement today beats years of attachments, judgments, and collection costs, the law gives SARS room to agree.

To get there, Section 201 requires a fully documented picture of your finances: assets and liabilities at today's value, twelve months of income and expenses, three years of asset disposals, and where the money is really going. Section 203 also rules out certain cases outright: a compromise in the last three years, other unresolved tax non-compliance, or a looming liquidation. We screen for all of this before you spend a cent.

02 · How it works

Five steps. Weeks, not years.

A compromise is a document-led process, not a phone call. Here's what actually happens once you're eligible.

  • Compliance Clean-up

Every outstanding return, across every tax type, gets filed first. SARS won't look at a compromise while anything else is outstanding.

  • Build the Financial Picture

We reconstruct your full asset, liability, income and disposal history: the exact disclosure Section 201 demands.

  • File the Request

A signed, reasoned motivation goes to SARS Debt Management with the Collection Information Statement and full supporting bundle.

  • SARS Reviews

Debt Management analyses the case; larger matters go to internal committee review before a senior official decides.

  • Agreement & Write-off

On acceptance, a written compromise agreement sets out what you pay. Perform it, and the rest is permanently written off.

03 · Is this you?

We'll tell you straight if this isn't the right fit.

A compromise only works for the right case. Here's the honest version before you go any further.

Good Signs

  • You genuinely cannot pay this debt in full, now or for the foreseeable future
  • Every other tax return and tax type is up to date
  • No other creditor is threatening liquidation or sequestration
  • You haven't disposed of significant assets to family or related parties recently
  • You're willing to fully disclose your financial position: assets, income, and all

Not yet, or Not This Product

  • You've had a SARS compromise in the last three years
  • Other returns or tax types are still outstanding
  • You could realistically pay this off over time: a Section 167/168 arrangement may suit you better
  • Liquidation or sequestration proceedings are already in motion
  • You're not prepared to disclose the full financial picture SARS requires

04 · Check yourself

Two minutes. Six questions. A straight answer.

This checks your case against the same criteria SARS itself applies before it will even consider a compromise. It's a screen, not an application, and it costs you nothing to find out.

Answer honestly. Nothing here is submitted anywhere: this stays on your screen.

Question 1 of 6

Can you genuinely not pay this SARS debt in full: now, or at any point in the foreseeable future?

This tool gives a preliminary, non-binding screen based on general SARS criteria. It is not legal advice and does not create a mandate or engagement with lawvero. A full review always precedes any application to SARS.

05 · FAQ

Straight answers

Will SARS write off all of my debt?

No. A compromise reduces the debt to an amount SARS accepts as the best realistic recovery: you still pay something, usually a lump sum or a short structured settlement, and the remainder is written off once you've performed your side.

Does applying hurt my credit or compliance standing?

A successful compromise doesn't damage your standing. It does require strict future compliance: miss that, and the full original debt can revive.

How long does this take?

Expect several weeks to prepare a complete, accurate application, and a further period, typically weeks to a few months, for SARS to review and decide, depending on the size and complexity of the debt.

What if I'm not sure whether to apply for a compromise or a payment arrangement?

That's exactly what the eligibility check above is for. As a rule of thumb: if you'll never realistically pay it all, a compromise is the right tool; if you can pay it off over time, a Section 167/168 payment arrangement usually serves you better.
