For divorces where both spouses agree. One fixed fee, agreed in writing before we draft a word.
Do both spouses agree to the divorce?
Do you have minor children?
The pack
A divorce doesn't fail on the big things: it fails on a summons issued in the wrong court, a pension clause the fund rejects, a parenting plan the Family Advocate sends back. Every document below is drafted from your answers and checked before it's sent to you to be issued.
Court document
Drawn for your correct Regional Court, with the grounds of irretrievable breakdown properly pleaded and executed.
Court document
The full deed of settlement (property, vehicles, debts, pension interest with the exact statutory wording funds require), made an order of court with your decree.
If you have children
Care, contact, guardianship and maintenance in a Children's Act–compliant plan, plus the sworn affidavit the Family Advocate requires.
Your court day
Where to go, what to bring, what happens, including your witness-box script: questions a court regularly asks, with the correct formalities to provide answers.
Or, at an agreed fee
If you'd rather not appear alone, we will refer you to attorneys that can assist with the appearance in your jurisdiction at agreed rates.
After the decree
Pension fund endorsement, property transfer instruction, and the will update most people forget, with fixed-fee options for each. Preview it in our free post-divorce checklist.
The process
Everything except the court appearance happens online and on paper. And if you choose to have an attorney represent you, they stand beside you for that part too.
A 20-minute guided questionnaire covers both spouses, the marriage, children, property and pensions, with document upload built in.
~20 min
We will confirm your regime and details against your documents, then draft your full pack for the correct court. We send you the complete set of documents with a guide to complete the process.
3–5 business days
You and your spouse sign the settlement agreement and parenting plan. We guide you on the steps to issue the summons OR refer you to an attorney, to be appointed by you, to assist with the further steps.
Your pace
An unopposed hearing. Yourself with the playbook, or with an appointed attorney: your call, made upfront or any time before set-down.
Free tools
Three free tools, built for South African divorces, that answer the practical questions before, during and after your matter. No sign-up, nothing to pay: use them as often as you like.
Before you start
Type your town or suburb and see exactly which courts can grant your divorce: the Regional Court option and the High Court seat, with the correct court heading and address.
Money & property
Work out who gets what under your marital regime: in community of property, out of community with or without accrual, or a customary marriage, and see what is excluded.
After the decree
Sixteen things that have to happen after the decree, in order, with the department, the form and the deadline for each: including the three statutory clocks that do not stop for you.
The tools give general information based on what you enter; they are not legal advice for your specific matter. Your answers stay in your browser and are not sent to us.
Your court day, your way
An unopposed divorce hearing is short: the court confirms the basics and grants the decree. The only question is whether you'd like company. Either way, you arrive with the same attorney-drafted pack.
Route A · Included
Thousands of South Africans finalise unopposed divorces in person every year. Our playbook makes it a checklist, not a mystery.
Included in your fixed pack fee
Route B · Agreed fee
A vetted attorney at your Regional Court handles issuing, service follow-up, set-down and the hearing, and stands with you in court. (The attorney will be appointed by you.)
Not sure yet? Choose in the questionnaire and change your mind any time before your hearing date is booked. The pack is identical either way. Reserved legal work and any court appearance is performed by admitted attorneys to be appointed by you at fixed rates and costs.
Fixed fees
No hourly billing, no surprise attendance fees. The only extras are third-party costs (the Sheriff's service fee and certified copies), which you pay at cost, with receipts.

Attorney appearance
Issuing, service follow-up, set-down and the hearing, handled at your court.
Flat fee quoted & agreed with your attorney before booking (we refer you to an attorney to assist with the process after drafting)
Third-party disbursements charged at cost: Sheriff's service fee (typically R150–R600 depending on distance and attempts) and certified copies of the decree. There is no court fee for issuing a divorce summons in the Regional Court. If your spouse unexpectedly opposes the action, it becomes an opposed divorce: a different process; we'll pause and explain your options.
Questions
Yes. This service is for unopposed divorces: where both spouses agree to divorce and on the terms (property, children, maintenance). If your spouse will oppose the divorce, that's a different court process with different costs; contact us and we'll explain your options honestly before you spend anything.
No: only the spouse bringing the divorce (the Plaintiff) testifies at an unopposed hearing. Your spouse signs the settlement agreement beforehand and doesn't need to attend. The hearing itself is usually very fast.
Yes. You have every right to appear in person in the Regional Court, and magistrates hear self-represented unopposed divorces daily. Our playbook gives you the full process and a witness-box script: the exact questions the court may ask and model answers. If you'd rather have an attorney beside you, choose to have an attorney go with you on the day and we'll refer you.
Yes: that's the Complete pack. The settlement agreement deals with the property (one of you keeps it, or it's sold and split), vehicles, debts and any settlement payment, and includes a pension interest order with the precise statutory wording retirement funds require. Getting that wording right is the single most common thing DIY divorces get wrong.
The Sheriff must serve the summons on your spouse personally. Our questionnaire captures their home and work addresses and the best times to find them, so the Sheriff succeeds first time far more often. If they're genuinely evasive, we'll advise on the next steps (like substituted service) and what it means for your timeline before you commit.
The Regional Court for the area where you (or your spouse) live. You don't need to work this out: we map your address to the correct court, and its Sheriff. Curious now? Try the free court jurisdiction finder.
Your intake is processed under POPIA solely for your divorce, and identity verification is done under FICA as the law requires. Your information is shared only with the admitted attorneys acting on your matter and, where applicable, the briefed attorney and the court process itself.
Divorce in South Africa · Plain answers
If you're researching a divorce, you probably have a dozen half-formed questions. Here are straight answers to the ones South Africans ask most: grouped by what you're really trying to work out. Nothing here is legal advice for your specific matter; it's the honest overview, and where it helps, we'll point you to the right next step.
South Africa has a no-fault divorce system: you don't have to prove anyone did anything wrong. The only ground is that the marriage has irretrievably broken down. A divorce is started by a summons, which must be served on your spouse personally by the Sheriff of the court. If your spouse agrees to the divorce and its terms, it's unopposed (uncontested): the fast, affordable route. If they fight it, it becomes opposed (contested), which is slower and far more expensive.
You can divorce in either the Regional Court (of the Magistrates' Court) or the High Court: since 2010 both can grant divorces. For a straightforward unopposed divorce, the Regional Court is cheaper and perfectly suited. The court must have jurisdiction, which it does if you or your spouse are domiciled or ordinarily resident in its area (residence needs at least a year in South Africa).
Our fixed-fee service handles unopposed divorces end to end. See the packs.
An uncontested (unopposed) divorce means both spouses agree to divorce and agree on everything that flows from it: how property is divided, arrangements for the children, and any maintenance. It's captured in a settlement agreement that the court makes an order. This is the quickest and cheapest divorce, often finalised in weeks.
A contested (opposed) divorce is where you can't agree: on the divorce itself or on the terms. It runs like a trial, with pleadings, possibly interim applications (see Rule 43 below), and a hearing. It can take one to three years and cost many multiples of an unopposed matter. Most divorces that start contested end up settling before trial, which converts them into the unopposed route.
If you both agree, you're unopposed: that's exactly what we do. If your spouse will fight it, tell us and we'll explain your options honestly before you spend anything.
How your assets are split depends on your marital regime: how you were married:
Beyond the regime, a settlement can deal with pension/retirement interest (a "pension interest order" with precise statutory wording the fund requires), the family home, vehicles, debts, spousal maintenance, and in some cases forfeiture of benefits or a redistribution order. Getting the pension wording exactly right is the single most common thing DIY divorces get wrong.
Not sure what your regime means for you? Our questionnaire works it out from your marriage details, and the Complete pack builds the correct orders in. For a first look, try the free asset division calculator.
South African law no longer uses the word "custody": it speaks of care (where the child lives) and contact (time with the other parent). The guiding principle in everything is the best interests of the child (Children's Act 38 of 2005).
Where there are minor children, the divorce must show the court their interests are protected. This is usually done with a parenting plan setting out care, contact, schooling, holidays and decision-making, and dealing with child maintenance. The Office of the Family Advocate may review the arrangements and endorse them. Child maintenance is each parent's duty in proportion to their means; the Maintenance Court can determine or enforce it.
Our With-Children pack includes a parenting plan and the children's affidavit the court expects, built around your family, not a generic form.
Cost depends almost entirely on one thing: whether it's opposed or unopposed. An unopposed divorce with agreed terms is a fixed, modest, predictable cost. A contested divorce billed by the hour can run into the hundreds of thousands, because nobody can predict how long a fight lasts.
Typical cost drivers for an unopposed divorce: whether there are minor children (a parenting plan is needed), whether there's property or a pension to divide, the Sheriff's service fee (a court cost, separate from legal fees), and whether you appear yourself or have an attorney appear for you. Beware anyone quoting by the hour for a simple, agreed divorce: that's how a R-few-thousand matter becomes a R-tens-of-thousands one.
We quote one fixed fee, in writing, before any work starts. See the three packs. Nothing is owed until you approve the quote.
An unopposed divorce is typically finalised in 6–10 weeks where there are no minor children, and around 10–18 weeks where there are (the Family Advocate's involvement adds time). The main variables are how quickly the Sheriff can serve your spouse and how busy your court's unopposed roll is; a busy court roll means you only get a date months later.
A contested divorce takes far longer: commonly one to three years, because of the pleadings, possible interim applications and the wait for trial dates.
The two things that slow an unopposed divorce down are service on your spouse and a full court roll. Our process is built to move fast on both.
An unopposed divorce runs on a specific set of documents: a combined summons and particulars of claim (which start the action and set out what you're asking for), a settlement agreement (your agreed terms, made an order of court), a parenting plan and children's affidavit if there are minor children, the Sheriff's return of service, a notice of set-down, and the draft order / decree of divorce.
The wording matters more than people expect. A pension interest clause with the wrong phrasing can be rejected by the fund; a vague settlement clause causes fights years later. "Divorce forms PDF" downloads rarely fit your facts or your court's requirements: which is why generic templates so often bounce.
Our packs are drafted by admitted attorneys around your answers, with the exact court-specific wording: not a one-size template.
At an unopposed hearing, usually only the spouse bringing the divorce (the Plaintiff) attends and answers a short set of questions; the hearing is often very short. The magistrate grants the decree of divorce and makes the settlement an order of court. You can lawfully appear yourself in the Regional Court, or have an attorney appear for you.
A Rule 43 application (High Court) or Rule 58 (Regional Court) is interim relief during a contested divorce: for interim maintenance, interim care and contact, or a contribution to legal costs while the main divorce is still running. In a genuinely unopposed matter you generally won't need one.
Choose to appear yourself with our witness-box playbook, or appoint an attorney to represent you. Either way, fully prepared.
Customary marriages (under the Recognition of Customary Marriages Act) are divorced through the same courts as civil marriages: a customary marriage is dissolved by a court, not customary process. Civil unions and same-sex marriages follow exactly the same divorce process as any other marriage. A foreign divorce may be recognised in South Africa if the foreign court had proper jurisdiction: worth confirming before you remarry.
DIY / online divorce: you're legally allowed to run your own unopposed divorce, and many people do. The risks are getting the documents or the court process wrong: a rejected summons, a defective pension clause, a settlement that causes disputes later. A fixed-fee drafted pack gives you the affordability of DIY with the documents done properly.
Whatever your marriage type, if the divorce is unopposed we can help: tell us your situation and we'll confirm honestly whether we're the right fit.
