Transfer Duty, Transfer Cost & CGT Calculator

Two tools in one: what a buyer pays to take transfer, and what a seller pays in capital gains tax on the sale.

Calculator

1. The transaction

Legal basis: Transfer Duty Act 40 of 1949, s2 (duty on acquisition) & s9(15) (VAT/duty mutual exclusion) · Value-Added Tax Act 89 of 1991

Seller status

Transfer duty and VAT never apply together. If the seller charges VAT on the sale, no transfer duty is payable: VAT is normally already included in the quoted price.

2. Bond (optional)

Legal basis: Deeds Registries Act 47 of 1937 (bond registration & fee schedule) · National Credit Act 34 of 2005, s101 (initiation fee cap)

Adds the bond attorney's registration fee and the Deeds Office bond fee, a separate cost from the transfer.

3. Disbursements estimate

Legal basis: Financial Intelligence Centre Act 38 of 2001 (FICA verification) · LSSA Conveyancing Fee Guideline (01.08.2025) for attorney disbursement practice

A typical bundle for a standard residential transfer. Your conveyancer will quote the exact figure, this is a placeholder you can adjust.

Both tools provide planning estimates only, not formal quotations or tax advice, and the legal-basis tags above each section point to the governing law but are not a substitute for reading it. Transfer duty is levied under the Transfer Duty Act 40 of 1949, s2, using the SARS sliding-scale table effective 1 April 2025 (unchanged for 2026/27 and 2027/28); s9(15) excludes duty where VAT applies under the Value-Added Tax Act 89 of 1991. Conveyancing and bond attorney fees follow the LSSA Guideline of Fees (effective 1 August 2025) issued under the framework of the Legal Practice Act 28 of 2014, a professional guideline, not a statutory tariff, and negotiable. Deeds Office fees are prescribed under the Deeds Registries Act 47 of 1937, Schedule of Fees of Office effective 1 April 2026 (Government Gazette 54225). Bank bond initiation fees are capped under the National Credit Act 34 of 2005. The CGT calculator applies the Eighth Schedule to the Income Tax Act 58 of 1962 (linked to the main Act via s26A): para 10 (inclusion rate: 40% individuals/special trusts, 80% companies and other trusts), para 45 (primary residence exclusion: R3,000,000 for disposals from 1 March 2026, R2,000,000 before that date, per the 2026 Budget), and para 5 (R50,000 annual exclusion for 2026/27). It assumes full-time, whole-property primary residence use with no apportionment for business/rental use, and does not account for the annual exclusion having been partly used elsewhere, prior capital losses, or non-resident withholding tax. Always confirm current figures and your specific position with your conveyancer and tax adviser before finalising a transaction or a tax return.
